Waiver
Please read and accept the below in order to participate in training at Hobart Martial Arts Academy.
WARNING AND ACKNOWLEDGEMENT OF RISKS, INJURY AND OBLIGATIONS
I acknowledge that the activity, Brazilian Jiu Jitsu, Mixed Martial Arts, Muay Thai, Fitness; I am to undertake, is a dangerous recreational activity, that may involve a significant risk of physical harm and by participating in it, that I am exposed to certain risks.
I further acknowledge that I am not required to engage in the activity.
I ACKNOWLEDGE AND UNDERSTAND that whilst participating in such activity:
• I may be injured, physically, mentally, or fatally.
• My personal property may be lost or damaged.
• Other persons participating in such activity may cause me injury or may damage my property.
• I may cause injury to other persons or damage their property.
• The conditions in which the activity is conducted may vary without warning.
• I may be injured or die or suffer damage to my property as a result of the negligence or breach of contract of the Recreational Activity Provider.
• There may be no or inadequate facilities for treatment or transport of me if I am injured.
• I assume the risk of and responsibility for any injury, death or property damage resulting from my participation in the activity.
RELEASE AND INDEMNITY TO HOBART MARTIAL ARTS ACADEMY, DERWENT VALLEY MARTIAL ARTS AND GERRY YOUNG
IN CONSIDERATION of my payment for participating in the activity (and except to the extent that the same may be precluded by statute) I AGREE TO RELEASE AND
INDEMNIFY the Recreational Activity Provider as follows:
1. I participate in the activity at my own risk and responsibility.
2. I release, indemnify and hold harmless the Recreational Activity Provider, its servants and agents, from and against all and any actions or claims which may be made by me or on my behalf or by other parties for or in respect of or arising out of any injury, loss, damage or death caused to me or my property whether by negligence, breach of contract or in any way whatsoever or any liability that results from the breach of an express or implied warranty that the recreational services or activity will be rendered with reasonable care or skill.
3. In the event that I am injured or my property is damaged, I will bring no claim, legal or otherwise, against the Recreational Activity Provider in respect of that injury or damage. Before signing this document I have read and understood it and know that it affects my legal rights.
I HEREBY ACKNOWLEDGE AND AGREE THAT:
• I have read the whole of this document and understand it.
• I consent to the person named in this acknowledgement and release participating in the activity.
• I am aware of the risks, dangers and obligations set out above in this acknowledgement and release, and
• If I am not the parent of the person named in this Acknowledgement, I shall at all times during the activity keep such person be under my control or in my company.
IN CONSIDERATION OF the person named in this Acknowledgement and Release being
accepted to participate in the activity I AGREE TO RELEASE AND INDEMNIFY the
Recreational Activity Provider in the same manner and to the same effect and extent as if I
were the person first named in this Acknowledgment and Release and the person participating in the activity.
Hobart Martial Arts Academy/Derwent Valley Martial Arts - Training Code of Conduct
The following make up the Hobart Martial Arts Academy Code of Conduct and it is a condition of Membership, that the Code of Conduct is adhered to at all times. Hobart Martial Arts Academy reserves the right to deny or withdraw membership to any person that does not abide by the Code of Conduct or to any person that may have a conflict of interest or that may have dishonourable intentions, behaviour or actions which in turn would bring discredit upon our club.
• Safety First - Be aware of you and your partners safety.
• Listen to and follow direction from Instructors at all times.
• Respect for the Gym and acknowledgement to the Senior Instructor.
• Respect all club members’ rights and equipment.
• Only approved clothing and/or footwear to be worn on the mats.
• Mouth guards should be worn while sparring.
• No jewellery on the mat.
• Always keep gym clean and tidy.
• Members of Hobart Martial Arts Academy/Derwent Valley Martial Arts are only permitted to represent approved teams in competition.
• Hobart Martial Arts Academy/Derwent Valley Martial Arts members are permitted to train in other academies, but are expected to train at Hobart Martial Arts Academy/Derwent Valley Martial Arts as a priority over other academies.
• The coach must be informed of any medical conditions or issues that may affect your safety or that of anyone attending Hobart Martial Arts Academy/Derwent Valley Martial Arts.
• The undersigned gives permission for photographs and videos taken in the club to be used for promotional purposes.
Hygiene Rules
• A Gi or Shirt / “rashie” [top] and Gi Pants/Shorts [bottom] must be worn at all times on the mat.
• No Food or Drink in the gym. [Re-hydration water bottles - OK]
• Finger and Toe Nails must be kept trimmed at all times.
• All cuts, abrasions or broken skin must be covered before going onto mats.
• Any and all spills of bodily fluids; in particular, blood, onto the mat surface, must be cleaned immediately.
